Under the
liability scheme established by the Comprehensive Environmental Response, Compensation, and Liability Act
(CERCLA) questions of what occurred at a hazardous waste site fifty or even one hundred years ago may be
of critical importance. Clarifying roles played by potentially responsible or liable parties requires
well-documented historical information on site ownership, management, production processes, and waste
disposal methods. Broader questions also may need to be addressed. These may include the state of
knowledge concerning environmental and health hazards at the time in which waste-generating activities
took place, corporate succession issues, and roles that government agencies played in regulating or
controlling activities.
Gaining
the knowledge needed to address these questions may require extensive research into the records of government
agencies and private corporations. A wide variety of documents and other forms of evidence may also need to
be unearthed ranging from land titles, to municipal utility franchises, to Sanborn Fire Insurance Maps and
historical photographs. Nor is it enough to merely obtain boxloads of documents and other historical
materials. To address many of the questions that arise in complex CERCLA cases, information from a wide
variety of sources must be extracted, pieced together, and placed in historical context. The expert
